Welcome to Confirm! These Terms of Service (“Terms”) govern your use of Confirm’s services, including our voice authentication powered by Pindrop, SMS one-time passcodes via Twilio, email one-time passcodes via Mailgun, API keys, access tokens, and any other services we provide (collectively, the “Services”). By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the Services.

1. Use of Services

a. Third-Party Services

We use Pindrop for voice authentication, Twilio for SMS one-time passcodes, and Mailgun for email one-time passcodes. These third-party services are integral to the functionality of our Services. By using our Services, you consent to the processing of your data by these third-party services as necessary for authentication purposes.

b. API Keys and Access Tokens

We provide API keys and access tokens to our customers for Single Sign-On (SSO) calls into our interface. You are responsible for maintaining the security of your API keys and access tokens. Confirm is not liable for any loss or damage arising from unauthorized use of your API keys and access tokens.

c. Data Minimization

We store minimal information about consumers, only retaining what is necessary to perform authentication. Our data collection and storage practices are designed to respect your privacy and are detailed in our Privacy Policy.

2. Geographic and Operational Information

Confirm is a company registered in Idaho, USA. While we operate solely within the United States, our team is remote. This geographic flexibility allows us to serve our U.S. customers efficiently.

3. User Responsibilities

You agree to use the Services only for lawful purposes and in accordance with these Terms. You are responsible for any activity associated with your account and for ensuring that your use of the Services complies with all applicable laws and regulations.

4. Intellectual Property

The Services and all related intellectual property, including trademarks, logos, software, and content, are owned by Confirm or its licensors. You are granted a limited, non-exclusive, non-transferable license to access and use the Services for your business purposes as permitted by these Terms.

5. Disclaimers and Limitation of Liability

The Services are provided “as is” without any warranties, express or implied. Confirm disclaims all warranties, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. In no event will Confirm be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Services.

6. Governing Law

These Terms are governed by the laws of the State of Idaho, without regard to its conflict of laws principles. Any disputes arising from these Terms will be resolved in the state or federal courts located in Idaho.

7. Modifications to Terms

Confirm reserves the right to modify these Terms at any time. We will provide notice of any significant changes by posting the new Terms on our website or through other communications.
